KVKK Clarification Text

It is important to process and preserve personal data in accordance with the Personal Data Protection Law No. 6698 (hereinafter referred to as “KVKK” or “Law”). For this reason, as TALE OF MAGIC TEKSTIL A.Ş. (hereinafter referred to as “TALE OF MAGIC” or “Company”), we act in accordance with the KVKK regarding the protection, preservation and processing of your personal data. We frequently receive data from you on the internet. Personal data received and recorded during the visit of our website are processed in accordance with the Law on the Protection of Personal Data. In this context, TALE OF MAGIC receives and maintains your data within the legal limits in the capacity of data controller. We would also like to state that; All personal data received during the visit of our website is also protected within the framework of our Privacy Policy. In this regard, you can review our Privacy Policy, which you can find on our page. This clarification text has been prepared by TALE OF MAGIC in the capacity of data controller within the scope of Article 10 of the Personal Data Protection Law No. 6698 and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Disclosure Obligation.

1.WHAT IS PERSONAL DATA?

Personal data is defined as “any information relating to an identified or identifiable natural person” in the Law No. 6698 on the Protection of Personal Data. As the definition suggests, any information that makes you identifiable is personal data. In addition to all these, political opinion, sect, race, religion, association-foundation membership, health information, philosophical thought, belief, sexual preference, criminal record, criminal conviction information, biometric data are personal data of special nature.

2. LEGAL BASIS

Law No. 6698 on the Protection of Personal Data stipulates that the persons whose data are processed must be informed before data processing activities are carried out. This issue, which is considered as the Obligation to Inform, is regulated under Article 10 of the Law on the Protection of Personal Data. It is stipulated in the Article “During the acquisition of personal data, the data controller and the person authorized by the data controller are obliged to inform the relevant persons about; The identity of the data controller and its representative, if any, for what purpose the personal data will be processed, To whom and for what purpose the processed personal data can be transferred, The method and legal reason for collecting personal data, Other rights listed in Article 11.”. 3 of this Law The Article defines the data controller as “the natural or legal persons who determine the purposes and means of processing personal data and who are responsible for the establishment and management of the data recording system”. Again, the data processor is defined as “the natural or legal person who processes personal data on behalf of the data controller based on the authorization granted by the data controller.” In this context, the data controller is TALE OF MAGIC, whose website you have visited. 3.SCOPE OF THE DISCLOSURE OBLIGATION OF THE DATA RESPONSIBLE TALE OF MAGIC The data controller is TALE OF MAGIC as explained above. In this Clarification Text, TALE OF MAGIC, in the capacity of data controller, informs and enlightens you about who and for what purpose personal data can be processed, to whom and for what purpose it can be transferred, the method and legal reason for collecting data and the rights of the data owner for the protection of personal data.

4. PURPOSES OF PROCESSING YOUR DATA BY TALE OF MAGIC Your personal data is processed within the limits stipulated by the Law No. 6698 on the Protection of Personal Data and based on the principles of the law. Our data processing purposes as TALE OF MAGIC within the framework of the law;

-To ensure that you benefit from the products and services offered by our company in the best way possible,
-As TALE OF MAGIC, to be able to develop, determine and secure our commercial partnerships and strategies, to make the right decisions in our commercial policies and managerial operations,
-As TALE OF MAGIC, to establish our corporate identity on a solid foundation and to ensure corporate functioning,
-Achieving the targets of our internal policies and thus increasing the satisfaction of our customers,

– To be able to contact those who send requests and complaints to TALE OF MAGIC,
-To ensure compliance with the provisions of the Privacy Policy on our website.

5. PRINCIPLES FOR PROCESSING YOUR DATA

a) To be kept for the period stipulated in the relevant legislation or required for the purpose for which they are processed;
b) To operate in accordance with the law;
c) To ensure that the data is up to date;
d) To act in accordance with the rules of honesty;
e) Not to be used for purposes other than the purpose for which it is processed;
f) Being proportionate and limited to the purpose for which it is processed;
g) To act in accordance with public morals, customs and traditions;
h) To process in accordance with the provisions of all relevant legislation, especially the provisions of the Personal Data Protection Law No. 6698; As TALE OF MAGIC, we have adopted the principle.

6-PROCEDURE OF DATA PROCESSING

a-YOUR PERSONAL DATA MAY BE PROCESSED BY TALE OF MAGIC IN TWO CONDITIONS. THESE TWO STATES ARE AS FOLLOWS:

1. EXPRESS CONSENT
2. CASES OF COMPLIANCE WITH THE LAW (CASES WHERE EXPLICIT CONSENT IS NOT REQUIRED)

b-CIRCUMSTANCES WHERE EXPRESS CONSENT IS NOT REQUIRED

Law No. 6698 on the Protection of Personal Data states that in some cases, explicit consent is not required for the processing of personal data. Law 5. Item 2. These situations specified in the paragraph are as follows:
– Explicitly stipulated in the law.
– It is mandatory for the protection of the life or physical integrity of the person who is unable to disclose his/her consent due to actual impossibility or whose consent is not legally valid.
– Provided that it is directly related to the conclusion or performance of a contract, it is necessary to process personal data of the parties to the contract.
– It is mandatory for the data controller to fulfill its legal obligation.
– It has been made public by the person concerned.
– Data processing is mandatory for the establishment, exercise or protection of a right.
– Data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject. In the presence of such situations, we have the right to process data as TALE OF MAGIC without your explicit consent.

7. METHOD AND LEGAL REASON FOR COLLECTING YOUR DATA

In developing and changing technological conditions, our company collects data from different channels. The website is one of the areas where we collect personal data automatically. Personal data collected through the website within TALE OF MAGIC are subject to the provisions of Article 5 of Law No. 6698. It is processed on the basis of one or more of the legal grounds set out in the article or on the condition of explicit consent. We would like to state that the data subject is informed according to the category and type of the processed data, the purpose for which the data will be processed, to whom and for what purpose the processed data can be transferred, the method and legal reason for data collection and the rights of the data subject are explained in the said clarification texts and explicit consent is obtained when necessary.

8. TRANSFER AND PROTECTION OF DATA

a- TRANSFER Your data is transferred to third parties when necessary in accordance with the Law No. 6698 on the Protection of Personal Data, in accordance with the conditions in our confidentiality agreements. For each transferred data, a detailed explanation is made in the Clarification Text made before the data is obtained, to whom and for what purpose the data can be transferred. However, under all circumstances, while TALE OF MAGIC transfers data, Law No. 6698 8. and Article 9 of the Convention. In addition, it takes the necessary technical and administrative measures.

b-PROTECTION The Law No. 6698 on the Protection of Personal Data mainly aims to protect data and prevent unauthorized transfer. As TALE OF MAGIC, we take the necessary technical and administrative measures to prevent the transfer of data to unauthorized third parties, especially the provisions of the relevant law. In this context, in particular, we make our internal policies in accordance with the Law on the Protection of Personal Data and we have all kinds of technical software and hardware for the protection of personal data. In order to ensure all these, we try to prevent both our employees within the company and third parties with whom we do business from violating our Privacy Policy.

9. RIGHTS OF THE DATA SUBJECT

a-GENERAL INFORMATION ABOUT THE APPLICATION

Law No. 6698 on the Protection of Personal Data 11. The Article stipulates the rights of the data subject. The Law defines the data subject as a “data subject” and provides for the right to make certain requests regarding the processing of his/her data. Pursuant to this article, the relevant person’s rights of claim are as follows:
a) Learn whether personal data is being processed,
b) Request information if personal data has been processed,
c) To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
ç) To know the third parties to whom personal data are transferred domestically or abroad,
d) To request correction of personal data in case of incomplete or incorrect processing,
e) Article 7 of the Law entitled “Deletion, destruction or anonymization of personal data” To request the deletion or destruction of personal data within the framework of the conditions stipulated in Art,
f) To request notification to third parties to whom personal data is transferred that incomplete or incorrectly processed data has been corrected or that the data has been deleted or destroyed upon the request of the data subject,
g) To object to the emergence of a result to the detriment of the person himself/herself by analyzing the processed data exclusively through automated systems,
h) In case of damage due to unlawful processing of personal data, to demand compensation for the damage.

You may submit your requests regarding your rights arising from the Law on the Protection of Personal Data explained above to our company within the framework of the procedure specified in this Clarification Text. Your requests will be answered by TALE OF MAGIC as soon as possible or within thirty days at the latest. Applications must be made by the data subject himself/herself. TALE OF MAGIC will only consider the application made by the data subject and share information about the applicant.

b-APPLICATION PROCEDURE You can submit your requests to TALE OF MAGIC, which is the data controller, regarding your rights mentioned above in writing or by using the registered electronic mail (KEP) address, secure electronic signature, mobile signature or the e-mail address previously notified to the data controller by the data subject and registered in the system of the data controller. In order to exercise your rights to request personal data, you can review the information on our website and use the “Information Request Form in accordance with the Law No. 6698 on the Protection of Personal Data” on our website.
